Terms of Use
Effective: Last updated:
These Terms govern access to and use of Paym websites, accounts, Paym IDs, payment pages and other Paym functionality currently made available by FinDech UAB.
Paym is currently under development and has not yet completed its general commercial launch. Some products, features, payment methods and jurisdictions described by Paym are planned, in development or available only for controlled testing. Where a regulated financial service is made available, Paym will identify the entity providing that service, its regulatory status and the applicable terms before the customer uses it.
1. About Paym
Paym is being developed as a global payment identity and payment-orchestration platform built around a Paym ID such as @username, a Paym link and QR code.
Paym is not a bank.
These Terms are platform Terms. They are not intended to replace any additional agreement required for a regulated payment, electronic-money, card, foreign-exchange, banking or other financial service.
The operator of the Paym platform is FinDech UAB, company code 307632436, Architektų g. 56-101, Vilnius, LT-04111, Lithuania.
2. Eligibility
Unless a particular Paym product expressly states otherwise, you must be at least 18 years old and legally capable of entering into these Terms to create and use a Paym account.
If you use Paym for an organisation, you confirm that you are authorised to act for that organisation.
3. Accounts
You must provide accurate and current information and keep it updated where the service requires it.
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out using your account, except where that activity results from a failure Paym could reasonably have been expected to prevent.
Paym may require email verification, identity verification or additional verification before an account, profile or payment feature can be used.
4. Paym IDs
A Paym ID is an identifier made available for use with Paym. Receiving or using a Paym ID does not transfer ownership of a word, business name, trade mark or other intellectual-property right.
Paym may:
- reject a requested ID
- reserve protected names
- restrict impersonation
- quarantine or suspend an ID for fraud, security or legal reasons
- respond to legitimate rights claims
- retire an ID associated with a closed account where required by Paym’s identity integrity policy
An activated Paym ID is treated as a permanent payment address. Closing an account retires the ID rather than making it available to someone else. Paym does not routinely recycle active Paym IDs.
You must not use a Paym ID to impersonate another person or organisation, mislead users about affiliation, infringe rights or facilitate fraud.
5. Acceptable use
You must not use Paym for fraud, unlawful activity, sanctions evasion, money laundering, terrorist financing, impersonation, unauthorised access, malicious software, exploitation or abuse, prohibited goods or services where applicable, or manipulating or interfering with payment or security systems.
Paym may apply additional acceptable-use or jurisdictional restrictions where required.
6. Pre-release and testing functionality
Some Paym functionality is pre-release, experimental or available only to selected users or controlled tests. Such functionality may change, be suspended or be withdrawn before general launch.
This clause does not authorise intentional mishandling of real money.
Where a controlled test involves a real regulated payment or financial service, the applicable provider disclosures and additional terms take priority for that regulated service.
7. Regulated financial services and partners
FinDech UAB develops the Paym technology and customer experience. Where Paym makes a regulated financial service available through an authorised third party, the service provider, regulatory status and applicable additional terms will be disclosed before you use that service.
Unless expressly stated otherwise for a specific service, these Terms do not mean that FinDech UAB itself is acting as your bank, electronic-money institution or payment institution.
Availability can depend on your country, profile, currency, verification status, payment method, provider and other eligibility requirements.
8. Payments, fees and FX
Where payment functionality is available, before confirmation Paym aims to display the material transaction information available for the selected route, including the amount, applicable fee, exchange rate where relevant, recipient amount and expected delivery information.
Quotes, rates or delivery estimates may expire or change before final authorisation. Delivery times are not guaranteed. Fees depend on the route, provider and circumstances of the payment and are not assumed to be zero.
9. Third-party services
Banks, payment providers, card networks, wallets, identity-verification providers and other partners may have additional terms. Those terms apply to their services.
10. Intellectual property
The Paym name, brand, software, design, APIs and related materials are owned by FinDech UAB or its licensors. These Terms give you a limited permission to use the service as made available. They do not transfer any intellectual-property right to you.
11. Privacy
Personal information is handled as described in the Privacy Policy.
12. Availability and changes
We do not promise that every feature will be available at all times or in every jurisdiction.
Pre-launch functionality may change as Paym develops. If a regulated product becomes generally available, material contractual changes must follow applicable law and any additional provider terms.
13. Suspension and account restrictions
Paym may restrict or suspend access where reasonably necessary for security, suspected fraud, a legal or regulatory obligation, sanctions, misuse, rights violations, technical risk, or inaccurate verification information.
We will provide information about a restriction when we can legally and safely do so.
14. Closing an account
You may request that your account be closed, subject to unresolved obligations and records we are required to retain. Closing an account does not mean that legally retained records are deleted.
15. Disclaimers
Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded.
Product previews, roadmaps and descriptions of planned functionality are not promises that a particular feature, payment method or jurisdiction will launch.
Nothing on Paym is financial, legal or tax advice.
16. Liability
Nothing in these Terms excludes or limits liability for fraud by Paym, wilful misconduct, death or personal injury to the extent such exclusion would be unlawful, statutory consumer rights, or any other liability that cannot legally be excluded.
Subject to that, Paym and FinDech UAB are not liable for loss that was not reasonably foreseeable, or for loss caused by a failure to follow these Terms, by information you provided incorrectly, or by a third-party service Paym does not control.
17. Governing law
These Terms are governed by the laws of the Republic of Lithuania, without depriving a consumer of mandatory protections that apply under the law of the consumer’s country of residence.
Courts in Lithuania will have jurisdiction unless mandatory consumer law permits or requires proceedings elsewhere.
18. Changes to these Terms
We may update these Terms as Paym develops. The current version and dates will always be published here. Where a change is material, we will provide reasonable notice where applicable.
